These Terms of Service ("Terms") govern your access to and use of the Southern California Triumph online store (the "Site"), operated by Southern California Motorcycles ("we," "us," or "our"). By accessing or using the Site, placing an order, or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years of age to use this Site or make a purchase. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and complete.
2. Products and pricing
We make every effort to display our products and pricing as accurately as possible. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, current, or error-free. Colors may vary depending on your monitor settings. All prices are listed in U.S. dollars.
We reserve the right to correct any errors in pricing or product information and to cancel any orders placed at an incorrect price. If an item you ordered is listed at an incorrect price, we will contact you before processing the order, and you will have the option to cancel the order or confirm it at the correct price.
Product availability is subject to change without notice. Motorcycles are one-of-one units: a listing describes a specific machine by stock number, and once it is sold that listing is no longer available. We reserve the right to limit the quantity of any product sold and to discontinue any product at any time.
3. Orders and payment
By placing an order, you are making an offer to purchase a product. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.
Payment must be made at the time of purchase unless we have agreed another method with you in writing. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. Bank transfer is available for motorcycle purchases and is arranged directly with our team. You represent that you are authorized to use the payment method provided.
We will never send bank account or wiring details in an unsolicited email, and we will never ask you by email to change payment details you have already been given. If you receive a message claiming to be from us that asks you to redirect a payment, stop and call us at (714) 256-6700 before sending anything.
You agree to pay all charges incurred by you or on your behalf through the Site, including applicable taxes, freight, and registration fees where they apply.
4. Motorcycles
Motorcycles sold through this Site are off-highway competition machines. They are not street legal, are not sold with highway registration, and are intended for closed-course or off-highway use only. It is your responsibility to comply with the laws that apply where you ride and where you register or transport the machine. A Manufacturer's Statement of Origin is provided for your records where applicable.
Motorcycles are sold one per order and separately from gear, apparel, accessories and parts. Freight scheduling and delivery requirements are confirmed with you directly after your order.
All motorcycle sales are final once the motorcycle is delivered or picked up. Motorcycles are not returnable or refundable. Inspect the machine before you accept delivery.
5. Shipping
We ship to addresses within the United States only. Orders of $99 or more qualify for free standard shipping on gear within the continental United States. Orders under $99 are charged a shipping rate calculated at checkout. Motorcycles are excluded from free shipping and ship at a flat freight rate to the contiguous lower 48 states. Alaska and Hawaii require a separate freight quote.
Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, holidays, or other circumstances beyond our control. Risk of loss and title pass to you upon delivery of the items to the carrier. Full detail is in our Shipping Policy.
6. In-store pickup
Free in-store pickup is available at 515 W Lambert Rd, Brea, CA 92821. You will receive an email notification when your order is ready. Please bring a valid photo ID that matches the name on the order. Gear and parts orders not picked up within 14 days may be cancelled and refunded.
7. Returns and exchanges
Gear, apparel and parts may be returned within 30 days of delivery, unworn and unused, in original packaging with all tags attached. Helmets and electronics are exchange only. Sale items are exchange only. Special-order items, installed parts, and opened chemical or electrical items are final sale. Motorcycles are final sale once delivered or picked up. 8. Intellectual property
All content on this Site, including text, graphics, logos, images, product descriptions, and software, is the property of Southern California Motorcycles or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. Manufacturer names, logos, and product names are trademarks of their respective owners and are used for identification purposes only.
You may not reproduce, distribute, modify, display, or create derivative works from any content on this Site without our prior written consent.
9. User accounts
You may create an account on the Site to facilitate your purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion.
10. Prohibited conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) interfere with or disrupt the operation of the Site; (c) attempt to gain unauthorized access to any part of the Site; (d) use automated systems such as bots, scrapers, or crawlers to access the Site; (e) submit false, misleading, or fraudulent information; or (f) infringe upon the rights of others.
11. Disclaimer of warranties
The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Product warranties, if any, are provided by the manufacturer. Refer to the manufacturer's warranty documentation included with your product for specific terms and coverage. Competition motorcycles may carry limited or no manufacturer warranty; ask us before you buy if warranty coverage matters to you.
12. Assumption of risk
Motorcycling, and off-road motorcycling in particular, is a hazardous activity that carries a risk of serious injury or death. You are responsible for your own riding, for wearing appropriate protective equipment, and for ensuring any machine you buy is suitable for your experience and intended use. Nothing on this Site is a representation that a particular machine is suitable for a particular rider.
13. Limitation of liability
To the fullest extent permitted by applicable law, Southern California Motorcycles and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the purchase of any products, including damages for loss of profits, data, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to these Terms or the Site shall not exceed the amount you paid for the specific product giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Southern California Motorcycles and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
15. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
16. Changes to these Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes take effect immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
18. Entire agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and Southern California Motorcycles with respect to your use of the Site and supersede all prior agreements and understandings.
